Plain English Summary: ARIA uses artificial intelligence to create social media content for your business. You are responsible for reviewing and approving what gets published. We are not liable for platform changes, algorithm shifts, or business outcomes. AI-generated content may not always be perfect — that is the nature of the technology.
1. Service Description
ARIA (“we”, “us”, “the Service”) is an AI-powered social media content creation and scheduling service operated by Alba Controls. We use artificial intelligence to generate images, videos, and captions for publication to your connected social media accounts.
2. AI-Generated Content
All content produced by ARIA — including but not limited to images, graphics, video, written captions, hashtags, and post copy — is generated autonomously by artificial intelligence systems. By using this Service you acknowledge and agree that:
- AI-generated content may contain errors, inaccuracies, or unintended material
- ARIA does not guarantee the accuracy, completeness, or suitability of any generated content
- You are solely responsible for reviewing content before it is published to your platforms
- ARIA selects images, captions, and posting times based on AI analysis and is not a licensed marketing advisor
- Nothing produced by ARIA constitutes legal, financial, medical, or professional advice of any kind
3. No Performance Guarantee
ARIA makes no guarantees regarding follower growth, engagement rates, sales conversions, reach, impressions, or any other metric. Social media performance depends on many factors outside our control including platform algorithms, market conditions, and audience behaviour. Past results shown on our website are illustrative and not a guarantee of future performance.
4. Platform Compliance
ARIA operates within the published terms of Instagram, Facebook, TikTok, and YouTube. However, social media platforms change their policies, algorithms, and API access without notice. We are not liable for:
- Account suspension, shadow-banning, or restriction by any platform
- Changes to platform APIs that affect our ability to publish content
- Reduction in reach or visibility caused by platform algorithm changes
- Loss of followers or engagement for any reason
5. Client Responsibilities
You agree to:
- Provide accurate business information during onboarding
- Connect social accounts that you own and have legal authority to manage
- Review published content and notify us promptly of any issues
- Ensure your business, products, and services comply with all applicable laws
- Not use ARIA for content that is unlawful, defamatory, or violates platform guidelines
6. Limitation of Liability
To the maximum extent permitted by law, ARIA and Alba Controls shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of business, loss of data, or reputational damage, arising from your use of the Service.
Our total liability to you for any claim arising from this Service shall not exceed the total amount you paid us in the three (3) months preceding the claim, or £500 / $500, whichever is greater.
7. Content Ownership
AI-generated content produced for your account is licensed to you for use on your business social media channels. You may not resell, sublicense, or distribute content to third parties without written permission.
8. Cancellation & Refunds
You may cancel at any time with no penalty. Your first 14 days are free — cancel before Day 14 and you will not be charged. After your trial, monthly payments are non-refundable but you may cancel before your next billing date to avoid future charges.
9. Autonomous Posting, Content Accuracy & Brand Voice
By connecting your social media accounts and activating the Service, you explicitly authorise ARIA to publish content to your accounts automatically, without requiring your approval of each individual post. This is the core function of the Service you have subscribed to.
Content Accuracy & Brand Voice: ARIA uses the business information you provide during onboarding to generate content. You acknowledge and agree that:
- ARIA makes no warranty that AI-generated content will accurately represent your products, services, pricing, availability, or brand voice at all times
- Content is generated based on the information you provided at onboarding — if your business changes, it is your responsibility to update your brand profile
- ARIA is not liable for any content that is factually inaccurate, misleading, or inconsistent with your brand if such inaccuracy results from outdated, incomplete, or incorrect information you provided
- You are responsible for reviewing published content and notifying us of any inaccuracies promptly
- We do not guarantee that content will perfectly match your preferred tone, style, or brand voice on every post — AI-generated content is subject to variation
Content Dispute Window: You have 24 hours from the time of publication to notify us at hello@thisisaria.ai of any post you want removed. Upon request within this window, we will use best efforts to delete the post from your connected accounts. After 24 hours, posts are considered accepted. You may delete any post directly from your own social accounts at any time.
- ARIA will publish content on your behalf without prior individual review or approval by you
- You have the ability to pause or cancel the Service at any time if you no longer wish for automated posting to continue
- You remain solely responsible for all content published to your accounts by ARIA
10. Data Processing, Privacy & GDPR
In order to provide the Service, ARIA requires access to your social media accounts via authorised API connections. By subscribing and connecting your accounts, you provide your explicit consent to the following data processing activities:
- Account credentials: Social media access tokens and API keys are stored in encrypted form and used solely to publish content and retrieve performance data on your behalf
- Performance data: We access follower counts, engagement metrics, impressions, and post statistics to optimise your content strategy
- Business information: Your brand profile, business details, and content preferences are stored and processed to generate relevant content
- Server location: Data is processed and stored on servers within the EU and/or United States. By using this Service you consent to this cross-border data transfer where applicable
- Retention: We retain your account data for 90 days following cancellation, after which it is permanently and irreversibly deleted from our systems
Your rights (GDPR / CCPA): You have the right to access, correct, or request deletion of your personal data at any time by emailing hello@thisisaria.ai. We will respond within 30 days. You also have the right to withdraw consent by cancelling the Service, which will trigger data deletion within 90 days.
Third parties: We do not sell, rent, or share your data with third parties for marketing purposes. We share data only with service providers necessary to deliver the Service (AI content generation tools, cloud infrastructure). All third-party providers are bound by data processing agreements.
Data Controller: Alba Controls is the data controller for the purposes of applicable data protection legislation. We are committed to compliance with GDPR (EU/UK), CCPA (California), and equivalent legislation in other jurisdictions.
11. Intellectual Property & Copyright
ARIA accepts no liability whatsoever for any copyright, trademark, or intellectual property claim arising from content published to your social media accounts.
AI-generated content is produced using licensed tools and image generation systems. However, you acknowledge and agree that:
- ARIA is entirely exempt from liability for any copyright, trademark, or IP infringement claim related to any content published on your behalf
- You bear sole and full responsibility for any and all intellectual property disputes arising from content on your accounts
- You indemnify, defend, and hold harmless Alba Controls, its directors, employees, and agents from any and all claims, damages, costs, and legal fees relating to intellectual property matters
- AI-generated images are produced via licensed third-party systems. We make no warranty as to their copyright status and accept no liability in this regard
- If you believe any published content infringes a third party's rights, you must use your platform controls to remove it immediately
12. Client Control & Acceptance of Responsibility
You have full capability to monitor, review, and delete any content published by ARIA at any time. Your connected social media platforms provide you with complete control over your account, including the ability to delete individual posts, pause your account, or disconnect ARIA at any time.
Because you retain this full capability and control, you accept that:
- ARIA is not liable for the continued presence of any content on your accounts — you have the tools to remove anything immediately
- Failure to exercise your right to review and delete content constitutes acceptance of that content and waives any claim against ARIA in respect of it
- Any harm, loss, or damage arising from content that remained published after you had the reasonable opportunity to review and remove it is your sole responsibility
- ARIA is not required to monitor your accounts for content issues — that responsibility lies with you as the account owner
- We provide the 24-hour deletion request window as a courtesy. Beyond this, all content management is your responsibility.
By subscribing to ARIA you confirm that you understand this is an automated service and that the responsibility for monitoring your own social media accounts rests with you.
13. Right to Terminate
We reserve the right to suspend or terminate your account immediately and without refund if:
- Your business, products, or content violate the terms of service of any connected social platform
- You use the Service to publish content that is illegal, defamatory, harmful, or discriminatory
- Your account is suspended or banned by a social media platform due to your own activities or prior violations
- You provide false or misleading information during onboarding
- You attempt to use ARIA to circumvent platform policies or engage in inauthentic behaviour
In such cases, no refund will be issued for the current billing period.
14. Service Level & What We Commit To (SLA)
We commit to the following service standards. These apply to ARIA’s own systems and are not affected by third-party platform outages (Instagram, Facebook, TikTok, YouTube) which are outside our control.
- Posting frequency: ARIA will publish the number of posts included in your plan each month. Posts are scheduled and published automatically. Individual post timing may vary by up to 2 hours from the scheduled time due to platform API queuing.
- System availability: We target 99% uptime for our posting engine. Planned maintenance will be communicated in advance where possible.
- Support response: We aim to respond to all support queries sent to hello@thisisaria.ai within 24 business hours (Monday–Friday, 9am–6pm GMT).
- Content generation: New content is generated and queued on a daily basis. If our system fails to post for more than 48 consecutive hours due to a fault on our side (not platform issues), you are entitled to request a pro-rated credit for the affected period.
What we do not guarantee:
- Posting frequency during social media platform outages, API rate limiting, or policy changes by third-party platforms
- Any specific level of reach, engagement, follower growth, or views from published content
- Uninterrupted service during events outside our control including internet outages, force majeure events, or platform-imposed restrictions on your account
Service credits for SLA failures are capped at the value of one month’s subscription and must be requested within 30 days of the failure. Credits will be applied to your next billing cycle.
15. Pricing & Changes
We reserve the right to change our pricing at any time. Active subscribers will be given at least 30 days written notice by email before any price increase takes effect. You may cancel before the price change takes effect with no additional charge. Continuing to use the Service after the effective date of a price change constitutes acceptance of the new pricing.
15. Platform Algorithm & Shadow Banning
Social media platforms including Instagram, TikTok, Facebook and YouTube use automated systems to detect and restrict content distribution. These systems can reduce or eliminate post reach without notice — a practice commonly known as “shadow banning.”
You acknowledge and agree that:
- ARIA cannot guarantee content will be distributed to any specific number of users or achieve any specific reach or views
- Platform algorithms may reduce, limit or suppress content visibility at any time and without explanation
- If we detect signs of reduced distribution or shadow banning on your account, we will proactively adjust your posting strategy — including pausing automation, changing posting frequency, or modifying content formats to help your account recover
- We will notify you when such adjustments are made and explain the reason
- Recovery timelines are determined by the platform, not by ARIA, and we cannot guarantee any specific recovery period
- ARIA posts content using methods consistent with platform guidelines, however platforms may update their policies at any time
Our goal is always to protect and grow your account. Proactive adjustments are part of the service, not a failure of it.
16. Changes to These Terms
We may update these terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms. We will notify active clients of material changes by email.
